Terms of Sale

These Terms of Sale govern all transactions between Pioneer Mitra Engineering Company ("Pioneer Mitra", "Seller") and buyers ("Buyer") for spare parts and related products. By submitting a purchase order or RFQ, the Buyer agrees to these terms.

⚠ All prices shown on this website are indicative only and are subject to change without notice. Final confirmed pricing is provided only via written quotation (email or WhatsApp) and is valid for the period stated in that quotation.

1. Indicative Pricing

All prices displayed on pioneermitra.com — including on the Parts Price Search page — are indicative reference prices in USD or INR. These prices:

A binding quotation is issued only upon written request and is valid for the period specified in that quotation (typically 7–14 days).

2. Orders and Acceptance

An order is accepted only when Pioneer Mitra issues a written order confirmation (by email or WhatsApp). Pioneer Mitra reserves the right to decline any order at its sole discretion.

Minimum order value for international export shipments is typically USD 500. Pioneer Mitra reserves the right to apply a minimum order surcharge for smaller orders.

3. Payment Terms

Standard payment terms for new buyers:

All bank charges are to the Buyer's account. Pioneer Mitra's bank details will be provided in the formal invoice. Payments must be made in USD unless otherwise agreed in writing.

4. Shipping and Incoterms

Default shipping terms are FOB New Delhi, India. Other Incoterms (CIF, C&F, EXW) are available on request and will be stated in the formal quotation.

Pioneer Mitra is not responsible for delays caused by shipping carriers, customs clearance, or force majeure events.

5. Product Description and Compatibility

Pioneer Mitra supplies aftermarket and compatible replacement parts. All parts are:

Buyers are responsible for verifying part compatibility with their specific machine model and serial number before ordering. Pioneer Mitra provides compatibility guidance in good faith but does not guarantee fitment for every machine variant.

6. OEM Brand Disclaimer

Pioneer Mitra Engineering Company is an independent spare parts supplier and is not an authorised dealer, official distributor, or service partner of JCB, Komatsu, Caterpillar, Volvo CE, Xylem, Flojet, or any other OEM brand. Use of OEM brand names and part numbers is solely for identification purposes. Pioneer Mitra is not responsible for any OEM warranty claims, recalls, or service bulletins.

7. Warranty

Pioneer Mitra offers a limited warranty on parts against manufacturing defects for a period of 90 days from the date of shipment. This warranty covers:

Warranty claims must be submitted in writing within the warranty period with photographic evidence. Pioneer Mitra's liability is limited to replacement of the defective part or refund of the purchase price, at Pioneer Mitra's sole discretion.

8. Returns and Cancellations

Returns are accepted only for parts with confirmed manufacturing defects (see Warranty above) or if the wrong part was supplied due to Pioneer Mitra's error. Returns must be pre-approved in writing.

Orders cancelled after production or procurement has commenced may be subject to a cancellation fee of up to 25% of the order value.

9. Limitation of Liability

Pioneer Mitra's total liability to the Buyer under any circumstances shall not exceed the invoice value of the specific parts giving rise to the claim. Pioneer Mitra is not liable for any indirect, consequential, or incidental damages including but not limited to loss of profits, machine downtime, or business interruption.

10. Governing Law

These Terms of Sale are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
